DUI Attorney Arrested For DUI Crash In Las Vegas

A skilled DUI attorney may employ many methods to defend a client facing a DUI charge. They may claim that the breathalyzer machine was incorrectly calibrated or that a field sobriety test was conducted improperly. If there was a blood test, they may put forth that the blood was mishandled by those testing the blood. They may also use what is known as a “rising blood-alcohol content” defense. In this defense, the lawyer will argue that a person’s blood-alcohol level was below the legal limit when they were driving and rose over the legal limit by the time they were tested.

The Review-Journal reports that a Las Vegas DUI lawyer has been arrested following a suspected DUI crash.

54-year-old Garrett Orgata was arrested on Friday following a crash that authorities suspect was DUI-related. It is Orgata’s third DUI-related arrest.

Officers responded to a call at 2:30 a.m. on Friday regarding a crash at the 215 Beltway and Eastern Avenue. The crash involved an Aston Martin and a Toyota SUV. Two occupants in the Toyota were hospitalized with their injuries. The injuries were not life-threatening.

Orgata was behind the wheel of the Aston Martin.

In 2016, Orgata was charged with a first-offense DUI, failure to maintain travel lanes, and driving 21 m.p.h. or more over the speed limit. He pleaded no contest to the DUI charge. The two other charges were dismissed.

According to his website, Orgata is licensed to practice law in California, Nevada, and Utah. His website also lists him as a member of the National College for DUI Defense and an instructor for the National Highway Traffic Safety Administration.

Orgata was released on his own recognizance and is due back in court on October 29th.
