The consequences handed down after a Los Angeles DUI conviction can include fines, license suspensions, and even jail time, but incarceration can be avoided in many drunk driving cases through alternative sentencing programs such as electronic monitoring.  That's right.  Just because you've been convicted of Los Angeles DUI doesn't mean that you must spend time in jail.  However, to find out more about alternative sentencing, you must speak with an experienced Los Angeles DUI attorney. Your attorney will be happy to discuss your case and figure out if alternative sentencing may work for you.

Electronic monitoring is also known as "house arrest" and allows you to remain at home instead of spending time in jail after a Los Angeles DUI arrest. House arrest is usually offered as a condition of probation, which means that if you fail to comply with the rules, you'll be charged with a probation violation and will likely spend time in jail.

You will be required to pay the cost of electronic monitoring after a Los Angeles DUI conviction. The costs typically include the device itself - a transmitter usually worn around your ankle and the cost of monitoring the device. There are many different programs and companies who are licensed to provide electronic monitoring.

If you're allowed to submit to electronic monitoring in lieu of jail, you may even be able to go to work during the day. You'll be required to remain at home during the evening, when most Los Angeles DUI arrests occur.

Most programs require you to wear an electronic device on your wrist or ankle that is linked to a monitor in your home. The device transmits a signal to the probation office or to the office of a monitoring company that tells authorities whether you're staying at home and complying with the terms of your house arrest.

Some house arrest programs require you to answer random phone calls to ensure that you're complying with the terms of your electronic monitoring program. Other programs use global positioning systems (GPS) to track you via satellite. The devices detect whether you're remaining within a designated area such as your home or place of employment.

Not every Los Angeles DUI offender is eligible for house arrest or other forms of alternative sentencing. For individuals with more than one DUI conviction within 10 years, jail time may be mandatory. First-offense Los Angeles DUI charges carry no mandatory jail time, but a judge can sentence you to up to six months in jail, and electronic monitoring may be a viable option.

A knowledgeable Los Angeles DUI attorney can evaluate your drunk driving case to establish whether electronic monitoring or another form of electronic monitoring may be an option. Contact us today for a free consultation.
